If this is 183 or greater and your number of days in the U.S. was at least 31 during 2024, then you would meet the substantial presence test. In Line 8r, enter the amount of scholarship and fellowship grants that were not reported on Form W-2. If you were a degree candidate, only include the amounts for expenses not including tuition and course-related expenses. Also bookkeeping andaccounting differences don’t report any nonemployee compensation shown on Form 1099-MISC, 1099-NEC, or 1099-K. You will need to refer to the Instructions for Recipient included on the respective tax form to determine how to report that income.

Who Needs Form 1040-NR: U.S. Nonresident Alien Income Tax Return?

For this foreign income to be treated as effectively connected with a U.S. trade or business, you must have an office or other fixed place of business in the United States to which the income can be attributed. For more information, including a list of the types of foreign source income that must be treated as effectively connected with a U.S. trade or business, see chapter 4 of Pub. Include any net investment income tax from Form 8960 for the part of the year you were a U.S. resident on Schedule 2 (Form 1040), line 12.

  1. For Form 1040-NR filers, canceled debt in box 2 of Form 1042-S should be included on Schedule 1 (Form 1040), line 8c.
  2. If you renounced your U.S. citizenship or terminated your long-term resident status, you may be subject to special rules.
  3. We ask for tax return information to carry out the tax laws of the United States.
  4. If your Form 1042-S or Form 1099-R does not show the taxable amount, you must figure the taxable amount and include that amount on line 5b.

Only U.S. nationals and residents of Canada and Mexico can claim a dependent on the same terms as U.S. citizens. No other person filing a Form 1040-NR can claim a qualifying dependent. Your filing status is Married filing separately if you’re married, even if you aren’t separated. The amount of your tax depends on your filing status. Report income or loss from rental real estate, royalties, partnerships, estates, trusts, and residual interests in real estate mortgage investment conduits (REMICs) on Schedule 1 (Form 1040), line 5. Use Schedule E (Form 1040) to figure the amount to enter on Schedule 1 (Form 1040), line 5, and attach Schedule E (Form 1040) to your return.

A Form 1040 return with limited credits is one that’s filed using IRS Form 1040 only (with the exception of the specific covered situations described below). However, you contributed $3,000 to your health savings account, $8,000 to a SEP IRA, and paid student loan interest adding up to $1,000. With a total of $12,000 in above-the-line deductions, your adjusted gross income is $79,000, meaning you’re likely eligible for the full American Opportunity Tax Credit.

You now receive monthly pension payments from your former U.S. employer’s pension plan. 70% of each payment is attributable to services you performed during 1980 through 1986 (7 years) and 30% of each payment is attributable to services you performed during 1987 through 1989 (3 years). Include 30% of each pension payment in the total amount that you report on line 5a. Include 70% of each payment in the total amount that you report in the appropriate column on Schedule NEC (Form 1040-NR), line 7. Only report ordinary dividends effectively connected with a trade or business on Form 1040-NR, line 3b.

Check the appropriate box for Canada or Mexico and skip to item H. See Days of Presence in the United States in chapter 1 of Pub. If you have winnings from blackjack, baccarat, craps, roulette, or big-6 wheel, and the casino gave you a Form 1042-S showing that tax was withheld, enter these winnings on line 11, column (d), and enter 0% as the tax rate. Don’t include any income that you elected to treat as effectively connected and included on Schedule 1 (Form 1040), line 5.

But see Married Filing Separately, later, for an exception. If you’re not a citizen of the United States, specific rules apply to determine if you’re a resident alien or a nonresident alien for federal tax purposes. Generally, you’re considered a resident alien if you meet either github the green card test or the substantial presence test for 2023. (These tests are explained in Green Card Test and Substantial Presence Test, later.) Even if you don’t meet either of these tests, you may be able to choose to be treated as a U.S. resident for part of 2023.
